PRELIMINARY TERMS & CONDITIONS FOR USING SERVICES

1.       Definition
1.1      "Service Provider" means TC Broadcasting Co., Ltd.
1.2      "Service User" means government agencies/state enterprises/organizations/legal entities/individuals who use the Services and have signed this document.
1.3      "Services" means satellite communication services for specific communication purposes for positioning and data transmission, used with the positioning devices and devices for connecting and transmitting data via satellite (Internet of Things devices (IOT)) as detailed or agreed in the satellite service agreement (or in any other named agreements) or as agreed upon in the purchase order or in any other form of written documents requesting the activation of Services.
1.4      "Equipment" means positioning devices and/or devices for connecting and transmitting data via satellite (Internet of Things devices (IOT)) that the Service User provides and uses in conjunction with the Services under the preliminary terms and conditions specified this document.
1.5      NBTC means the National Broadcasting and Telecommunications Commission.
2.       The preliminary terms and conditions for using the Services
2.1      The preliminary terms and conditions for using the Services are effective between the Service User and the Service Provider.
2.2     The Service User has read and understood the preliminary terms and conditions for using the Services and fully and completely understand the details in this document, including any other terms and conditions that the Service Provider may specify on the Service Provider's website (https://www.thaicom-globalstar.com) or any other documents. Therefore, the Service User agrees to use the Services and has signed this document.
2.3    The Service User must strictly adhere to the terms, conditions, and/or service manuals as specified by the Service Provider and must not use the Services in any illegal manner, contrary to the Service Provider's terms, and/or against public order or good morals.
2.4   In using the Services, the Service User agrees and acknowledges the limitations of satellite communication technology used for the provision of  the Services. For example, the Equipment can effectively transmit signals  in open areas and cannot be used in caves, deep valleys, dense forests or underwater. Therefore, it is the responsibility of the Service User to ensure that the Service User and/or the Equipment are in a position, coordinate, or area where the Equipment can properly function under such limitations.
2.5      The Services do not include the provision of emergency signal transmission to relevant rescue agencies (e.g., hospitals, emergency medical units, police stations, disaster relief foundations, rescue centers, etc.). The Service Provider has no obligation or guarantee to conduct rescue operations. The decision to conduct search and rescue operations depends on various limitations and considerations beyond the management and control of the Service Provider such as rescue teams, operational constraints, available resources, technical feasibility, weather conditions, and safety.

2.7   The Service User agrees that the Service Provider may use its personal data outlined in this document to provide the Services and for the benefit of telecommunication management in compliance with the NBTCs regulations on protecting user data. The Service User has the right to request for an access to, a copy of, a certification of true copy of,  a correction to, suspension of use, or withdrawal of its consent for, its personal data by submitting a written request to the Service Provider. If the Service Provider does not fulfill the request, the Service User may contact the NBTC for an enforcement. If the Service User requests for such access, copy, certification of true copy of its personal data, the Service Provider may charge a fee in accordance with the guidelines given by the NBTC of not exceeding the actual cost incurred by the Service Provider.
